These terms are the agreement between you and ReadSense, the developer and provider of the ReadSense app ("we", "us"). The seller of record is shown on the app's App Store page. By using ReadSense you agree to them. If you do not agree, do not use the app.
ReadSense is a reading app for iPhone and iPad. You import your own EPUB books and read them. When you tap a word or select a passage, ReadSense explains what it means in that place in the book (a "lookup").
Explanations are written by an artificial intelligence model. They are a reading aid. They can be wrong, incomplete or out of keeping with the author's intent, and they are not professional, academic or legal advice. Use your own judgement.
You bring your own books. They stay on your device. You are responsible for having the right to use the files you import. We do not check where a file came from, and we do not sell, supply or host books, apart from the sample book included with the app.
ReadSense opens EPUB files without copy protection (DRM). It does not open protected files and must not be used to get around protection.
A new installation of ReadSense includes 50 free lookups. They do not renew and do not expire. A device that has already had a trial may be given fewer, or none. Reading your books does not need lookups and stays free.
To keep using lookups after the free ones you need a subscription, monthly or annual. Both plans include the same thing.
A subscription is for one person's reading. It includes at least 1,500 lookups in each month of the subscription. That is a guaranteed minimum, not a cap: lookups continue past it. Each lookup has a cost to us, and each subscription month has a ceiling on that cost. Most readers never reach it. If you do, lookups pause until the date your next month begins, which the app shows you, and the app warns you when you are close. Unused lookups do not carry over.
There are also limits on how fast lookups can be made (a few dozen a minute and a few hundred a day), which ordinary reading does not reach.
We may refuse or limit lookups from an installation or a subscription that does any of these.
Lookups need an internet connection and depend on services run by others, including the AI provider and our hosting provider. We work to keep them running but do not promise that lookups will always be available, quick or free of error. Reading works without a connection.
ReadSense will change. We may add, alter or remove features, change the AI model or provider, and change limits. We will not reduce the guaranteed minimum of section 5 during a period you have already paid for. If we stop offering lookups altogether, subscriptions will not renew.
We may update these terms. The date at the top shows the latest version. If a change matters to you and you do not accept it, you can cancel; continuing to use the app after a change means you accept it.
The app, its design and its software belong to us and our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, as the App Store's usage rules allow. The books you import remain yours or their rights holders'. We claim nothing in them. Explanations are generated for you to read; we claim no ownership of them, and we do not promise they are unique or free of others' rights.
The Privacy Policy at https://readsense.app/privacy explains what is sent when you make a lookup and what is kept. In short: your books stay on your device, the text needed for a lookup is sent to our server and on to the AI provider to produce the answer, and we do not keep it.
To the extent the law allows, ReadSense is provided "as is" and "as available", without warranties of any kind, express or implied, including that explanations are accurate or that the app will meet your needs or run without interruption.
To the extent the law allows, we are not liable for indirect, incidental or consequential loss, or for loss of data or profit, arising from your use of ReadSense. Our total liability to you for any claim is limited to the amount you paid for ReadSense in the twelve months before the claim arose.
Nothing in these terms takes away rights the law gives you that cannot be given up. If you live in the European Union, the United Kingdom, Australia or anywhere else whose consumer law gives you guarantees and remedies that cannot be excluded, you keep them, and sections 10 and 11 apply only as far as that law permits.
These terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to conform to a warranty that applies, you may notify Apple, and Apple will refund the purchase price to you; to the extent the law allows, Apple has no other warranty obligation for the app. We, not Apple, are responsible for addressing claims about the app, including product liability claims, claims that it fails to meet a legal requirement, consumer protection and privacy claims, and claims that it infringes someone's intellectual property.
You confirm that you are not in a country under a United States Government embargo or designated as supporting terrorism, and that you are not on any United States Government list of prohibited or restricted parties. You must keep to any third-party terms that apply when you use the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You can stop using ReadSense at any time by deleting the app; cancel any subscription with Apple first, as deleting the app does not cancel it. We may end or suspend your use if you break these terms. Sections 8 and 10 to 14 continue after the agreement ends.
These terms are governed by the laws of the State of Illinois, United States, without affecting the mandatory consumer protections of the place where you live.
